Saving Private Ryan Essays - Operation Overlord, Operation Neptune

Saving Private Ryan June 6, 1944. Military forces converge on the beaches of Normandy for one of the most decisive battles of World War Two. America would call this a victory. History would call it D-Day. But for Captain Miller and his squad of young soldiers, the day after the landing on Omaha Beach would change all of there lives. They would get a special order from Washington ordering them to go on a personnel mission to save one life. One soldier lost three of his brothers in combat. One on Omaha Beach, one on Utah Beach, and the other in New Guinea. They realize this is not a simple mission to save a life but a test of their honor and duty. Their sole obsession-and their last hope for redemption. Upon arriving at Omaha Beach Captain Miller was faced with many problems. The Germans were awaiting the arrival of the American forces and attacked the ships landing on the beach before the troops were even able to exit the boats. Many of Millers men were lost on the beach along with many men from many other companies. Miller lead his mean along a wall on the beach and over took German forces to escape with most of this troop in tact. What he didn't realize was that on of the men lost on the beach was a Private Ryan. Captain Miller continued to lead his men into enemy territory despite the loss of some of his men. He then reached a friendly base set up. Upon arriving at the base he received orders that his mission would be changing. He was told of the Private Ryan that died at the Omaha beach invasion. He was also told of the other two Ryan boys from Iowa that had already died in the war. He wasn't really sure why he was being told this. Then the worst part came. He was ordered to try to find the one remaining Ryan brother. No one was sure where he was or if he was even alive. He was told of an earlier incident where three brothers from Iowa had all been killed in the war and the mother was left alone. The United States army was now ready to risk the lived of Captain Miller and seven of his men to try and save this one man just so his mother wouldn't have to lose her only remaining son. To Captain Miller this seemed a little extreme. Think of our mothers thought Miller and his men. They had no choice though, they were under orders. Along the way Millers company would stop by another American base to pick up an American soldier to translate to the German civilians they would meet along the way. They traveled to may abandoned and demolished remains of what used to be towns in search of Private Ryan. Miller lost many of his men along the way during encounters with German paratroopers and hidden German machine gun nests. But despite loosing many men they were able to continue. The met remaining parts of an American Paratrooping unit along the way to somewhat replenish their forces. But the paratroopers weren't in much better shape than Millers bunch. They continued in search of Ryan and finally found him in a town on the river. He was in a patchwork infantry trying to prevent the Germans from taking a bridge that was vital to the strategies of the United States Army. Private Ryan wouldn't leave with Miller though, he insisted on staying and fighting the Germans. He didn't want to be remembered as a coward. Miller agreed, and his men, battered and beaten, also agreed to stay and fight one last fight before going home. They managed to hold off the German advances until help arrived. They again lost many men in this effort but Private Ryan survived. Captain Miller has reached his goal and Ryan would make it home. I thought this was a very good book. I thought it made a very good point about some of the difficult decisions facing the men in the middle of a hostile environment in another country and the bravery shown by many men in the heat of battle. I can't say if I were placed in the same position if I would be able to do the same thing as some of those men. The New Super Power essays

The New Super Power essays What is the debate on weather or not China should retain favored-nation trading status all about? Is it really a decision on what is best economically for the United States, and China. Or is it: the issue of Chinese human rights violations and the fact that if the United States where to revoke the favored nation status of China it would have a profound negative impact on the U.S. economy alone. (+)Most-favored-nation trade status started in the United States as a version of the European preferential trade system. The Carter Administration first granted most-favored-nation trading status to China in 1980, following the historic efforts of President Nixon during the 1970s to restore diplomatic ties. Historically, a significant difference existed between the unconditional most-favored-nation clause in European trade law and the American version of conditional most-favored-nation. Under unconditional most-favored-nation status, one country's extension of tariff concessions guarantees the same concessions to all nations associated with it through commercial treaties. American conditional most-favored-nation status provided treaty signatories only the opportunity to negotiate most-favored-nation status when most-favored-nation status was extended to another trading partner. Thus meaning that the United States gives significant economic advantages to one nation in the form of mo st-favored-nation trading status. Under the Trade Act of 1974, most-favored-nation status could only be granted to China through a Sino-American bilateral commercial agreement and satisfaction of the Jackson-Vanik Amendment requirements. The Jackson-Vanik amendment states that the President of the United States may grant a communist country such as China most-favored-nation trade status if it was in conjunction with a trade agreement and upon proper improvement that China would permit emigration. Also China would have to satisfy that they are moving tow...

How to Obtain a Copy of a Social Security Application Form SS-5

How to Obtain a Copy of a Social Security Application Form SS-5 Once youve found your ancestor in the Social Security Death Index, you may want to request a copy of your ancestors original Social Security Application. An excellent record for genealogical information, the SS-5 is the application form used by an individual to enroll in the U.S. Social Security program. What Can I Learn From a Social Security Application (SS-5)? The SS-5, or Application for Social Security Number is a great resource for learning more about individuals who died after about 1960, and generally includes the following: Full nameFull name at birth, including maiden namePresent mailing addressAge at last birthdayDate of birthPlace of birth (city, county, state)Fathers full nameMothers full name, including maiden nameSexRace as indicated by the applicantWhether the applicant ever applied for Social Security or Railroad Retirement beforeCurrent employers name and addressDate signedApplicants signature Who is Eligible to Request a Copy of the SS-5? As long as a person is deceased, the Social Security Administration will provide a copy of this Form SS-5, Application for Social Security Number to anyone who makes a request under the Freedom of Information Act. They will also release this form to the registrant (the person who belongs to the Social Security Number) and to anyone who has a release-of-information statement signed by the person about whom the information is sought. To protect the privacy of living individuals, there are specific requirements for SS-5 requests involving extreme age. The SSA will not provide a copy of the SS-5 or otherwise release information about any person  who is under 120 years old unless you can provide  acceptable proof of death (e.g.,  death certificate, obituary, newspaper article, or police report). The SSA will also redact (black out) parents’ names on an SS-5 application unless you provide proof that the  parents are deceased or  both have a birth date more than 120 years ago. They will also release parents names  in cases where the number holder on the SS-5 is at least 100 years of age. This restriction is, unfortunately, a bit tricky when your purpose of requesting the SS-5 is to learn the names of the parents. How to Request a Copy of the SS-5 The easiest way to request a copy of the SS-5 form for your ancestor is to apply online through the Social Security Administration. A printable version of this SS-5 Application Form is also available for mail-in requests. Alternatively, you can send (1) the persons name, (2) the persons Social Security Number (if known), and (3) either evidence of death or a release-of-information statement signed by the person about whom the information is sought, to: Social Security AdministrationOEO FOIA Workgroup300 N. Greene StreetP.O. Box 33022Baltimore, Maryland 21290-3022 Mark both the envelope and its contents: FREEDOM OF INFORMATION REQUEST or INFORMATION REQUEST.   There is a fee of  $27.00 regardless of if the  Social Security Number is known, and you must provide the persons full name, date and place of birth, and names of parents. If you have a Social Security Number from family records or a death certificate but are unable to locate the individual in the SSDI, then it is strongly suggested that you include proof of death with your application, as it will likely be returned to you otherwise with that request. If the individual was born less than 120 years ago, you also need to include proof of death with your request.   The usual wait time for receiving a copy of a Social Security Application Form is 6-8 weeks, so be prepared to be patient. Online applications are generally a bit quicker - often with a turnaround time of 3-4 weeks, although this may vary based on demand. Also, it is important to note that the online application system doesnt work if you need to provide proof of death.

Discussion Paper Assignment Example | Topics and Well Written Essays - 500 words

Discussion Paper - Assignment Example In economics terms, scarcity is referred to as the lack of sufficient factors of production needed in the production of certain goods and services. Economists maintain that scarcity exists on economy-wide bases. For e.g. Individuals want many things for consumption but they have to go without some. Businesses have a choice of buying certain equipment in which they have to make a choice and go for the best option. Similarly, economies face scarcity when they decide to produce certain good with finite resources and forego the others. The concept with which these choices are made is called â€Å"Opportunity Costs†. This is a basic principle concerning scarcity. The concept holds that opportunity cost is giving up the next best alternative for the best and most rational choice. Similarly, trade-offs is another option to counter scarcity, so as exchange and international trade. In this class, we expect that we will be given certain tools and techniques that will help us manage the problem of scarcity and will help us deal with it in the most efficient manner. This will minimize the impact of scarcity and help us make rational choice given the quantities of finite factors of production at our hand. Equilibrium means balance and where there is no tendency to change. Market equilibrium is a situation where the plans of buyers meet the plans of suppliers at a particular price and hence there is no tendency to change as it will bring about varying outcomes from the perspective of both buyers and sellers. Therefore, it is the price at which a certain quantity of goods is supplied and bought and where a market is working efficiently. An example of how a change in demand resulted in change in price can be taken from oil industry. From 2000 onwards, the global economy experienced a boom. As a result, demand for oil started increasing exponentially. This resulted in increase in oil prices and oil prices reached near to $140/barrel in the first half of

State and local GOVT Assignment Example | Topics and Well Written Essays - 500 words

State and local GOVT - Assignment Example Public merit personnel system has become important in terms or ensuring that federal employment is given to the qualified individuals. However, it has been stated, â€Å"the greatest professional challenges for public merit personnel are at the local level. The merit principle entails the selection and appointment of the best person for any given job (Bowman & West, 2006). This is the first instance where the challenge comes because public appointments have leaned towards professionalism, even at the local level. Professionals link professionalism to possession of knowledge and are attached to group identity. When applying issues of merit for a job at a local level more issues other than professionalism such as gender and race balance issues are considered to get the best individual for the job and this is a challenge. In looking at pay for performance systems, which is a type of public merit personnel system, both Perry et.al (2009) and Bowman (2010) found out that public merit personnel systems at the local level have many challenges that are caused by issues that include lack of adequate funding, inability to distinguish levels of performance, lack of employee confidence in merit systems, employee-manager distrust and bureaucratic resistance to merit systems among others (Bowman, 2009: Perry, Engbers & Jun, 2009). These issues show that the above statement is true. Discuss the implications for state and local governments of the Intergovernmental Personnel Act of 1997 (Revised). http://www.opm.gov/policy-data-oversight/hiring-authorities/intergovernment-personnel-act/#url=Provisions. What issues were addressed and why do you think they were included in the Act. The Revised Intergovernmental Personnel Act (IPA) mobility program regulations came into effect from May 29, 1997 allowing federal agencies to operate efficiently and productively. The PetsMart Essay Example for Free

The PetsMart Essay Introduction   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   This paper presents a brief background on PetsMart, identifies its vision and mission statement for the current timeframe, differentiates PetsMart’s current generic strategy from that of Camp Bow Wow, and completes a remote analysis by indicating the opportunities and threats for each remote factor in a table form. Background on PetsMart   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   PetsMart, established in 1989, is the number one retailer of pet food, supplies, accessories, and services in North America with 726 retail stores, of which 25 are located in Canada. Its retail store size ranges from 19,000 to 27,000 square feet, and sells over 12,900 items (Gilliard, 2005, p. 5). It employs about 30,300 associates, of which roughly 50 percent are full time (p. 7). It entered the international arena in 1996. Its major competitor is Petco—both Petsmart and Petro overlap in some geographical locations of business operation (p. 2). Other competitors for these two largest stores are Target and Wal-Mart; other major sources of competition are from grocery stores. Its potential competitor will be Camp Bow Wow. Vision and Mission Statement for PetsMart   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   PetsMart’s vision is â€Å"to provide Total Lifetime Care for pets and build enduring relationships with its customers† (p.   6). Its mission is to lead the global retailing market of pet food, supplies, and services. PetsMart Strategy vs. Camp Bow Wow Strategy   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   PetsMart strategy is to capture and keep a group of identified pet owners or pet parents by being the â€Å"preferred provider for the lifetime needs of pets† (p. 6). To accomplish this, PetsMart carried out the following customer-focused initiatives: (1) expansion and efficient operation in existing and new multi-store and single store markets, to make its products and services more available to customers, and at the same time reach to out new customers; (2) reformat stores like specialty stores through organization of products by pet species, emphasis on pet services, and removal of high steel shelving to help customers navigate easily inside the store; (3) provision of pet services to build better relationships with customers; (4) training of associates to determine customer needs, and offer solutions to further develop customer loyalty; (5) development of brand identity through PetPerks savings card to create a sense of belongingness of customers in PetsMart and at the same time taking advantage of price savings. Petsmart uses a centralized information system to analyze customer shopping patterns, the results of which will be used for marketing and promotional materials.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Camp Bow Wow was conceptualized in 1994 to take advantage of the growing market and took off in 2000. It started a day care facility for dogs and later expanded its operations to include overnight boarding. It also takes care for puppies, older or sickly pets. It offers on-site grooming, vaccinations, indoor/outdoor play areas, climate controlled facilities, pools and play equipment (p. 11). It has a different strategy from that of PetsMart. It adopts franchising as a rapid growth strategy. It requires franchisees to provide excellent services to pet owners, maintain outstanding facility, and share its earnings to local dog charities. It offers franchisees operational and training support, research and development information, linkages to quality suppliers, and commitment to growth. Its owner has great plans and vision for franchising, such as (1) use consistent operations systems, and similar look and style; (2) develop and sale of brand dog food and biscuits, and human and dog sportswear at the franchise location; (3) develop services like mobile grooming, pet taxi services, in-home pet sitting, and poop scoop services; (4) develop and maintain operations systems, training programs, and marketing strategies to manage its brand name; (5) monitor company growth to allow profitability; and (6) build a non-profit foundation for national or regional dog charities (p. 12). Remote Analysis of the PetsMart Remote Factor Opportunities Threats Economic  ·Ã‚  Ã‚   The surge of consumer spending increases net sales.  ·Ã‚  Ã‚   The strategic alliance between PetsMart and Medical Management International, Inc. ensures sufficient supply of veterinarians, and efficient delivery of veterinary services to customers.  ·Ã‚  Ã‚   Good economic outlook definitely increases pet customers and their spending volume on pets and pet-related products and services.  ·Ã‚  Ã‚   Any dollar appreciation will shoot up sales on pets and pet-related products.  ·Ã‚  Ã‚   High inflation rate reduces consumer spending on pet accessories.  ·Ã‚  Ã‚   High unemployment rate lowers the number of pet customers and reduces consumer spending on pets and pet food, accessories and services.  ·Ã‚  Ã‚   Seasonal incomes provide fluctuations on spending pattern on pet accessories and services.  ·Ã‚  Ã‚   Shortage of qualified veterinarians limits offer of veterinary services, and reduces consumer spending on pet services.  ·Ã‚  Ã‚   Shortage of skilled employees to train and groom pets hampers service efficiency, and reduces consumer spending on pet services.  ·Ã‚  Ã‚   Limited capacity of local and overseas vendors gives no assurance of timely delivery of products, quality of product and labeling and packaging requirements, and volume requirements; and jeopardizes efficient customer-focused services.  ·Ã‚  Ã‚   Global expansion of international competitors restricts PetsMart global expansion plans, and consequently reduces consumer spending on its products in foreign markets.  ·Ã‚  Ã‚   Currency exchange rate fluctuations provide no steady or increasing international consumer spending pattern on pet products. Sociological  ·Ã‚  Ã‚   The demographic trends—â€Å"growth of baby boomers, empty-nesters, couples with no children, and other people delaying marriage and children†Ã¢â‚¬â€increase consumer spending as numerous pet owners raised their pet status as members of the families and pampered them with luxurious pet products and services, like pet insurance, hotels, spa, pet frequent flyer programs, and pet toys.  ·Ã‚  Ã‚   The shift of this demographic trends—e.g., aging of baby boomers, people decided to get married and have children—may affect consumer spending on pets and related pet products and services.. Technological  ·Ã‚  Ã‚   Diverse and innovative products induce consumer spending on pet-related products. PetsMart’s products are categorized as (1) pet food, treats, and litter category; (2) pet supplies and other goods category like collar, aquarium, bird cages; and (3) various pets, like dogs, cats, fish, birds, reptiles, and small pets.  ·Ã‚  Ã‚   New and innovative pet services that complement the products attract higher consumer spending. PetsMart services include grooming, pet training, boarding (PetsHotel), day camp (Doggie Day Camp), and on-site veterinary services.  ·Ã‚  Ã‚   Innovative products and services supports other complementary products in the market, like insurance and airline frequent flyer perks, which, in turn, has positive ripple effects on Petsmart.  ·Ã‚  Ã‚   E-commerce sales of pets and related products and services (www.petsmart.com) provide unlimited market place to a wider customer base within 24 hours at lower costs, and increase sales.  ·Ã‚  Ã‚   Innovative branded catalogues provide flexible and updated presentation of products and services attract customers, and thereby increase sales.  ·Ã‚  Ã‚   Product and service diversification opens multiple lines of competition—creating opportunities for competitors to enhance existing pet-related product lines and introduce new products, which will eventually outmode Petsmart products.  ·Ã‚  Ã‚   Petsmart cannot reap the full advantage of its on-line pet store as its competitors also established and maintained similar innovation. Political  ·Ã‚  Ã‚   Loosening of regulations decreases monitoring and compliance costs.  ·Ã‚  Ã‚     Political stability supports global expansion.  ·Ã‚  Ã‚   Monitoring and complying in federal, state, and/or local regulations increases costs.  ·Ã‚  Ã‚   Tariff increases and other trade barriers reduce exports of pet products, and reduce import spending in foreign countries.  ·Ã‚  Ã‚   Compliance to employment regulations on minimum wage, working conditions, and staffing requirements increases costs and reduces profit level.  ·Ã‚  Ã‚   Compliance to laws and regulations on transporting, handling and selling of pets, may be difficult as they are governed by federal, state and local government. At the local level, they differ from one jurisdiction to another. Ecological  ·Ã‚  Ã‚   The establishment of PetsMart Charities has saved the lives of homeless pets by not leaving them astray. This increases animal welfare awareness, and customers treat PetsMart fairly for its concern on animals.  ·Ã‚  Ã‚   In addition to dog charity initiative, PetsMart may consider other line of business, like collecting, disposing, and conversion of animal wastes into fertilizer or energy.  ·Ã‚  Ã‚   Environmental regulations increase production costs and consequently reduce profits. These regulations affect pet facilities on the â€Å"generation, handling, storage, transportation, and disposal of waste and biohazardous materials†.  ·Ã‚  Ã‚   Any sickness or plague that attack on birds halts sales of pet birds.  ·Ã‚  Ã‚   Environment advocates might lobby on proper handling and disposal of wastes—which might hurt the sales in the short run. Source: Gilliard (2005). Conclusion   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   PetsMart experiences the fastest retail growth and profits, reflecting the overall trend of the pet industry. This attracts new entrants into the industry. And PetsMart should not be complacent and needs to continually guard itself from risks or threats at both the industry level and external environment to maintain its leading position. Its current strategy seems to work well so far. But in the long-run, considering significant changes in both industry conditions and external environment, shouldn’t there be strategy shift? Shouldn’t it adopt franchising as what Camp Bow Wow did to increase sales and enhance product quality? Reference Gilliard, D. J. (2005). The Pet Care Industry: From PetsMart to Camp Bow Wow.

Proposal for Pine Valley Furniture Ecommerce Webstore Essay -- Busines

Proposal for Pine Valley Furniture Ecommerce Webstore Now is the time to implement an Ecommerce webstore, and Eysie and Sehr Management Information System Consultants are the people who can make it happen. In an effort to maintain a competitive advantage Pine Valley Furniture needs to implement an ecommerce webstore. Making this transition and developing a webstore illustrates Pine Valley Furniture's commitment to change with the times and will prevent the loss of market share by competition. Trying to justify why Pine Valley Furniture needs to develop a webstore is futile, the reality is that developing a web-store for Pine Valley Furniture is a matter of survival. This proposal is a guideline and a road map in making Pine Valley Furniture a competitive webstore. First off, we need to focus on what our business objectives are and who our target audience is. As a corporation, our business objectives are to increase revenues for the shareholders while expanding our growth and lowering our costs. Market research has indicated that the areas of Corporate Furniture, Home Office Furniture, and Student Furniture have vast growth potential if properly managed on a webstore. If we are to create a webstore based fundamentally on pushing these three lines, we need to characterize what type of people will be buying these items. Corporate Furniture has a broader potentiality of selling in larger bulk quantities, while Student and Corporate Furniture will focus more on customization and personalization. Now that we had identified what it is that we want to sell on our webstore and who it is that we want to sell it to, we can now choose what type of hardware and software we will need. In order for our system to be operating at maximum efficiency, Eysie and Sehr Management Information System Consultants recommend a three tiered system because of existing system compatibilities. Tier one will consist of a web server layer, this layer will handle incoming internet requests, load balance requests, display html pages, route web requests to application server, and assemble data from an application server into web pages for clients. (George, 259) The second tier is the application server layer, this layer will authenticate users, process transactions, retrieve and send data to web server, and retrieve and send data to existing appli... ...dware is located off site, application is developed professionally and managed off site, and thus provides excellent emergency response. Some disadvantages of this option would be that it is inflexible, difficult to integrate with existing systems, and the resources are shared with other clients. (George, 258) The second option is to enterprise a resource planning system. The advantages of this would be stability and available documentation. Disadvantages of this option would be that it requires internal development, and would render documentation crucial during planning and development. (George, 258) The last thing that we need to address is how essential the commitment to this transition is. If this is going to be a successful transformation, the entire organization must exhibit unilateral support from the CEO throughout the entire organization. In conclusion, Eysie and Sehr Management Information System Consultants are willing to implement this ecommerce system for Pine Valley Furniture and are eager to do so as soon as possible. Relationship between the three arms of government

The American government as a democratic government functions under the guidance of three government arms. The role of each arm of government is clearly spelt under the doctrine of power separation that sought to offer clear guidelines to allow the smooth and effective execution of government affairs. Bernas (1997) however claims that there are several government departments within these separate arms of government that have overlapping roles and that one certain issues it is hard to decide which arm the jurisdiction of such a controversial issue falls. However, it is argued that the founders of the nation sought to ensure the independence of all branches to ensure their supremacy in dealing with their particular spheres. However, it is necessary to note therefore that the functions of these arms of governments must adhere strictly to the constitution raising the question of who should be charged with the responsibility of enforcing those provisions. The executive arm of the government is fundamentally important to carry out the day to day running of the country. This power is usually vested upon the president and any person that the president deems fit to have power delegated to him. Therefore, the constitution mandates a duly elected president to appoint such individuals as he may see fit subject to the approval of congress. This paper in essence tries to focus on this relationship whereby a particular of the government is subject to the oversight of another in carrying out its duties. It therefore becomes necessary for the president to appoint such individuals as qualified to handle their respective duties and such individuals must hold high integrity for them to get the necessary legislative backing. The president enjoys immense powers under the constitution among which includes the responsibility of defending the constitution and protecting the United States from attacks. For this purpose it is important that his powers be subject to some form of oversight in order for it not to be misused to the detriment of ordinary Americans. The legislature is a basic necessity in any democratic nation and the United States is a pillar of freedom and hence the United States congress is the custodian of law formulation in the nation. The legislative wing consists of two separate houses expected to ensure effective and just formulation of laws to the benefit of society. The legislature is also charged with the responsibility of formulation laws regarding tax and authorizing various government expenditures. Furthermore the senate has complete authority to authorize the signing of treaties involving the nation bringing to the question of whether the executive has any true autonomous powers. It is also important to note at this juncture that it is not only congress that has influence on the executive but also the executive has considerable influence over the legislature. Most committee chairmen are appointed by party leaders, plus the fact the party leader also appoints a majority leader in congress to spear head party agendas in congress. In this regard the executive has considerable influence on the direction of congress even in ignoring the fact that the president has veto power over bills passed in congress. The other arm is the judiciary charged with the administration of justice based on equality, equity and integrity. The courts are the grounds through which conflicts are to be resolved and injustices either compensated or punished. In these solemn corridors of justice civil and criminal proceedings are initiated and the process of establishing guilt or innocence cleverly and impartially established. The court is also charged with the important duty of interpreting the constitution and establishing whether certain statues are constitutional or not. The appointment of judges is however left to the hands of the executive on the confirmation of the legislature. The judiciary is also charged with the duty to protect the rights and f reedoms of the American citizens against the exploitation of both the executive and the legislature. In this regard, the court is mandated to provide guidance and authority to the executive on the application of certain statutes that might infringe on the rights of the citizens. In this regard the court acts as the oversight authority on the excesses of the both the executive and the legislature by putting the interest of the citizens before all else. There are those who feel that oversight over government branches should be left to the masses. However, such a claim becomes rather untenable since there are no clear mechanisms to identify breach of constitution since most people lack the technical expertise to interpret the constitution.Furthermore, even when such a breach might be on the public domain there are no mechanisms for the public to stop legislation or the enforcement of the same. There fore, it becomes necessary to allow the court since it has been charged with matters per taining to the administration of justice and the upholding of the constitution. The court has the technical and legal mandate to interpret the constitution and therefore has the moral authority to rule on matters regarding the constitutionality of matters pertaining to changes or issues related to the constitution (Coxe, 2005).Opponents of the judicial power of review would seem to be lost in the fallacious belief that the authority of the judiciary to review legislations enacted by congress and senate as an interference of the role of the legislature. It can be argued if the status of other countries like the U K that bars courts from reviewing primary bills was to be taken into consideration that indeed the judiciary might have exceeded its jurisdiction. However, it is necessary and the constitution clearly stipulates that any law that is contrary to the constitution is null and void. Therefore, it is simply logical that the judiciary in exercising its role of constitutional interp retation make rulings on the constitutionality of bills passed by the legislative wing of government. This is because law makers might if no oversight exists make laws that are in their favor even if they are in contravention of the constitution. This is possible since the constitution might be subject to misinterpretation and due to its impartial nature, the judiciary can be trusted to enforce the provisions of constitution against the partisan interests of politicians. The status quo has not always been so since the various arms of government did not infringe on the operations of the other. The courts oversight on the constitutionality of legislations emanated from the ruling of the case, William Marbury v. James Madison, secretary of state of the United States. The court had ruled that Marbury’s petition to the court under the judicial act of 1789 to compel the secretary of sate to deliver his commissioning document was unconstitutional (Marshal, 1803). However, it is clear that since the three branches serve as one government, they cannot function without relating and providing oversight to each other. This creates accountability and checks against power abuse which might disadvantage the very people they are sworn in to serve. The legislator serves as an oversight against the executive and so the court must serve as and oversight on the legislature. Therefore, the present relation ship between the three branches is vital for the necessary functioning of the country and in the observance of the supremacy of our constitution. References Bernas, J. Alcon Gove PTY Limited

The economic valuation principles highlights the bottom line of any energy efficient or cost saving measure that will determine whether to proceed with a specific implementation (Anon n. d. ). The company ensures that in all cases when necessary they prevent, minimise, mitigate and remediate potential harmful effects of the Group's operations on the environment (Rio Tinto 2010). The company has been very much proactive with the program of Greenhouse Challenge and since 2001 they even voluntarily submitted its annual greenhouse gas emissions inventory.Since Rio Tinto Alcan Gove’s operations as a whole expends a lot of energy they continuously identify energy efficiency improvement projects prior to the of the Energy Efficiency Opportunities Act (Australian Government Dept of resources, energy and Tourism 2009). According to the company on their Sustainable development review, their focus on providing sound governance and high standards of conduct in which they felt that this wo uld give a competitive advantage over the industry. They are an active member of the International Council on Mining and Metals (ICMM) for the purpose of providing leadership on scientific and policy matters, consistent communication with all stakeholders and promote applying the sustainable development principles to promote best practice performance standards (Rio Tinto 2010). Just recently an example of this activity was displayed. When the company plans to invest $340 million in a molybdenum facility, in which has the capability of processing a lower-grade molybdenum concentrate to be processed more efficiently than through conventional roasters, basically this facility is much more safer and reliable to use for its employees and produces a more high quality product that even its by-products can be utilized which will be also beneficial for Rio Tinto (Utah Pulse 2010). 2- What will be the impact on the consumer of the product or serviceThe impact based on these strategies and polic ies employed internally by Alcan Gove will actually benefit all consumers for its products and services. By being cautious regarding safety and mitigating risks for environment, Rio Tinto displays its integrity by building this foundation of compliance with relevant local laws and regulations and international standards. Consumers tend to choose a company that offers a good quality product that also has done measures to ensure that overall business operations reduces or better yet prevent risks to safety and damaging effects on the environment.3-How might consumer behaviour affects the business's profitability in general terms Consumer behavior definitely has great effects on any overall business profitability. People’s needs and expectations drive demand, and based on statistics on industries especially for developing economies the growth rate in terms of this market can be related to potential significant sales for Alcan Gove (United Nations 2005).Another thing that may imp act demand is the perception of Alcan Gove’s consistent measures to ensure safety for its employees and reduction on environmental impacts, this will create a reflection on how concerned the company is on its surroundings which translates better to the behavior of overall consumers to purchase from them. 4-How could the business respond to these changes to minimise their impact and maximise the benefit to stakeholdersThe company should maintain their strategy on sustainable development, and guarantee that their operations and products as well will be continuously used and developed appropriately throughout their lifecycle. Another strategy that can be employed is on reduction of environmental footprint of their operations, which includes making sure that balancing the impact of overall operations with enhanced environmental outcomes, economic development and overall efficiency of operations. For various types of stakeholders, instant and significant monetary gains may not be e xpected as early as now, but with the continuous improvements focusing on sustainable development and steady growth, stakeholders will reap those rewards soon. A dream that was never fulfilled Essays - Allegory, Animal Farm

A dream that was never fulfilled Essays - Allegory, Animal Farm A dream that was never fulfilled By Benjamin the donkey Date: 12/4/2015 I used to live my life in the shadow of the Farm walls; I lived half of my life alone in that solitary, as I see things like a camera from all points of view but I never interfere up until the moment my best friend who worked so hard to build this farm was injured badly and he almost died and in that moment I opened my eyes and started to document what was happening in the Farm in the last couple of Years. I was a normal Animal who worked my hours in the farm during the day but in the night I interviewed Animals to see their points of view about their life under Napoleon leadership. My first interview was with boxer and it went as the following: Boxer what do you think about Napoleon? Hmmm Napoleon is a good leader but he always wastes our time in searching for Snowball, and his last act with the four Pigs was inappropriate and the Dogs are going brutal as it was the first time in my whole life seen an Animal kill an Animal! But I know one thing for sure which is too work harder than ever to finish building the windmill and retire. After the battle with Mr. Fredrick I went to Squealer and asked him few questions. Squealer may I speak with you? yes comrade. I would like to ask you few questions? Yes no problem. Who do you think should earn an medal for being the War hero? Of course our leader Napoleon as without his instructions and faith in us we will be dead by now and that being said I would like to leave as I have a very confidential meeting with the pigs. A few days passed until the pigeons came running with the news that Boxer has fallen as most of the animals rushed there and saw what happened after a few days I interviewed Boxer again and asked him what happened. - I thought that we need to finish the windmill as soon as possible and I worked so hard before retiring as my muscles have failed me but this time when I get better I am not going back to work for good. After this conversation between us the carriage came and it was written in the back horse slaughter and by the time I finished reading the carriage was long gone was Boxer trapped in it. Years and years have passed and the next thing we saw in the farm was astonishingly unexpected when the pigs came back from their secret training they were no ordinary pigs they were semi humans as they were standing on two legs and wearing coats. So I rushed over to Clover and had a little conversation with her s ince shes one of the animals who lived and survived after the rebellion. Clover lets go and check the commandments and what we found out left us in a shock for a while and the commandment was like ALL ANIMALS ARE EQUAL BUT SOME ARE MORE EQUAL THAN OTHERS. After we saw that commandment and that Boxer hard work was all in vein and his goal to build a better place for animals was torn all apart I might not be as smart as the pigs but I know for sure that old major dream and vision was all in vein and his dream to create an equal place for all the animals was forgotten as I decided to forget too and get back to living in the shadows.

Managing organizational design and change Essay

Managing organizational design and change - Essay Example Persons must always come together to form an organization. A workable system and structure set up by more than two people forms an organization. (Fleming, 1989) describes it as a process of identifying and putting together the work to be performed, through definition and delegation of authority and responsibility, while establishing a relationship for the sole duty of ensuring that people work most effectively together in achieving set objectives. With systems and structures an organization is formed. This is by setting up of policies, rules, laws and chain management to run the whole set up structure. When a chain of management is put in place it is tasked with implementation of the set policies and rules. Policies form a critical phase in the running of the company. Leadership also forms a critical part in the running of an organization. With good and well governed leadership an organization is bound to excel and meet its targets and objectives. Lack of leadership and set policies and targets and organization will fail. This is an indication that an organisation is a group of people who have come together to work towards achieving a common goal guided by a given leadership. People with the same ideals, goals, and targets come together to form an organisation. The organisation is therefore tasked with the duty of achieving the set goals and target that have been made by various individuals. The leadership and management structure of any organisation is tasked with the duty of laying up structures and polices which ensures that an organisation is well run and organized. Organizations therefore implement the set policies and rules to ensure that their objectives are met. Organizations are formed to implement the policies and targets set up by the people who run it. Organizations can never be all the same. This is due to the varied nature of objectives of each organization. Depending on its objectives one organization will be

Primacy of EU Law over National Law Essay Example | Topics and Well Written Essays - 2750 words

Primacy of EU Law over National Law - Essay Example Regulations are laws with general application, such that member states are under no strict liability to adopt them into national law. In the case of directives, that obligation is unconditional on the part of member states, although they can choose the form and methods by which to implement an EC directive 2. These provisos in the new EU Constitution are highlighted by this paper in its discussion of how to bring law and order to European countries if the EU law relevant to a particular case contravenes the national law of a member state; if an EC regulation favors one national group over another; or if an EC law that could bolster a local case has no equivalent version in the member state that is hearing the case. In so doing, the paper presents two make-believe cases involving consumer welfare promotion and environmental protection, two areas of concern high on the agenda of the new Constitution as embodied in Article II-62 and Article II-97, respectively. Both areas need state legislation to give them real substance. In 2006, EC issued E... The directive imposes criminal liability on anyone who keeps toxic chemicals in his property without sufficient safeguards to prevent leakage. If the stored chemicals, which were specified in the EC directive, escape into the atmosphere and cause harm to people, the offense carries a maximum fine of 150,000 euros or its equivalent. In UK, authorities believed there was no need to enact a new law based on the EC directive because there is a similar environmental law already in place. In March 2007, or one year after UK member states were supposed to have introduced the EC directive into their own legal systems, a man named Simon fell ill after eating vegetable grown in his garden, which is adjacent to a warehouse of Otis Chemicals Ltd. that stored the chemicals identified in the EC directive.QUESTION 1: If you're a lawyer representing Otis Chemicals, do you think Simon can sue your company in UK under the EC environmental directive based on the direct effect principle Can UK authorities also prosecute Otis under the same EC directiveANSWER: Assuming that the chemical substance in question is among those identified in the EC environmental directive, Simon can invoke the same EU law in bringing a case against Otis Chemicals before UK courts. This he can do whether or not UK has adopted the provisions of the said EC law into a national law. Under the Community Method principle of the new EU Constitution, any law enacted by the Community automatically becomes an integral part of the law of a member state, whose courts are
